Case Presenter Pro: terms and conditions
Version of 11 October 2026
These terms are the agreement between you, the business that registers to use Case Presenter Pro, and Compass HR. Please read them. The clause headed Exclusion of liability and indemnity limits your rights and asks you to protect Compass HR against claims, and you will be asked to accept it separately when you register.
1. Who we are
Case Presenter Pro (the App) is provided by Compass HR, enterprise number 2001/005282/23, VAT number 4350193084, of 14 Chalbre Crescent, Bel Aire, Somerset West, 7130. Email greg.wright@chrsa.co.za. Website chrsa.co.za. In these terms "we" and "us" mean Compass HR, and "you" means the business that registered and every person who uses the App under its account.
2. What the App is, and what it is not
- The App helps an employer prepare for a disciplinary enquiry or an arbitration. It organises evidence and documents, suggests case law, and drafts opening statements, questions for witnesses, the employee's likely defence and responses to it, and closing statements.
- The App uses artificial intelligence to produce that material. Artificial intelligence can be wrong. It can misread facts, leave things out and cite case law that does not say what it claims, or that does not exist.
- The App gives guidance only. It is not legal advice and not legal representation. Using it does not create an attorney and client relationship, or a consultant and client relationship, between you and Compass HR or Greg Wright.
- Nothing the App produces is a prediction or a guarantee of the outcome of any enquiry, arbitration or court case.
3. Who may use the App, and your responsibilities
- The App is for employers only. It may be used only by an employer, and by its owners, managers, HR practitioners and advisers acting for it. It may not be used by an employee, by a trade union or its officials, or by anyone acting for an employee in a dispute with an employer. We may close any account that breaks this rule, without refund.
- Before anything the App produces is relied on or used in an enquiry or arbitration, it must be reviewed by your own HR practitioner, or another suitably qualified person in your business. That person can change any of it, and remains responsible for what is used.
- You must check every case citation on SAFLII (www.saflii.org) before relying on it, including those marked "Verified by CHR".
- You are responsible for the accuracy and completeness of the information and documents you enter, and for every decision you take about an employee.
- You must have the right to use the information you enter. Use initials rather than full names for employees and witnesses wherever possible.
- Keep your login details private. Each login is for one person and may not be shared. You are responsible for everything done under your account, including by every user you add.
- You may not try to get around the credit system, gain access to the App's connection to its AI provider, copy or resell the App or its output as a service, overload it, or use it for anything unlawful.
4. Your account and the free trial
- A new business may use the App free for 7 days with R50.00 of trial credit. One free trial is allowed per business.
- When the trial ends, you need a subscription to keep using the App.
- The person who registers is the account holder. The account holder may add other users from the same business, up to the number the plan allows, and must remove anyone who leaves the business or should no longer have access. All users share the account's credit. Only the account holder can make payments, change the plan and see tax invoices.
- We may suspend or close an account that breaks these terms, or where we reasonably suspect misuse.
5. Subscriptions, credit and payment
- Prices are shown excluding VAT, with the VAT and the price including VAT next to them. VAT is charged at 15%. You pay the price including VAT.
- Payment is taken by PayFast. Your card details are handled by PayFast and never reach us.
- A subscription renews automatically each month, or each year if you chose annual payment, until you cancel it. You may cancel at any time from your PayFast account or by emailing us. Your access continues until the end of the period you have paid for.
- Preparing cases uses credit. Credit comes with your subscription each month, and you can buy more. Before each request the App holds the most it could cost from your balance, and afterwards it charges only what was used. You can never be charged more than the credit you have.
- You may choose which AI model prepares your case. A stronger model gives a more thorough answer but uses credit faster. Claude Opus uses credit about twice as fast as the recommended Claude Sonnet for the same work. The App shows this when you choose.
- Credit expires 12 months after the date it was bought or added, and your oldest credit is used first. Expired credit cannot be refunded or reinstated. Credit has no cash value and cannot be transferred.
- Subscription fees and credit are not refundable, except where the law requires a refund.
- We will give you at least 30 days' notice by email of any price change. The new price applies from your next payment after the notice period.
- A tax invoice is issued for every payment and is available on your account page.
6. The shared case law bank
- When the App prepares a case, it records the case law it relied on: the names of the parties, the court, the case number, the date, the passage relied on and the topic. Nothing about you, your employees or the facts of your case is recorded with it.
- You agree that this case law may be kept in a shared case law bank owned by Compass HR, and that case law which Compass HR has checked may be used in preparing cases for all users of the App. Only Compass HR has access to the bank itself.
7. Privacy (POPIA)
- We keep your account details (name, company, email address, password in scrambled form, VAT number and address if you give them), your acceptance of these terms, your payments, credit and a record of each request (date, type and cost). We use this to run your account, bill you, keep our accounting records and prevent misuse.
- The facts and documents of your cases are not stored on our server. They are kept in your own browser or in files you save. When you prepare a case, that content is sent to our AI provider, Anthropic, which processes it on servers outside South Africa to produce your answer. By using the App you agree to that transfer.
- We keep account and payment records for as long as the law requires us to keep accounting records, and otherwise for as long as your account is open.
- You may ask to see, correct or delete your personal information by emailing greg.wright@chrsa.co.za. You also have the right to complain to the Information Regulator.
8. Exclusion of liability and indemnity
- Full exclusion. To the fullest extent the law allows, Compass HR, Greg Wright, and Compass HR's members, employees and agents are not liable to you or to anyone claiming through you for any loss, damage, cost or claim of any kind, direct or indirect, arising out of or in connection with the App, its availability, or any use of or reliance on anything it produces. This includes loss caused by negligence.
- Your indemnity. You indemnify Compass HR, Greg Wright, and Compass HR's members, employees and agents against every claim, award, order, loss, damage, cost and expense, including legal costs on the scale as between attorney and own client, that any third party brings or obtains against any of them arising out of your use of the App or of anything it produces. Third parties include your employees, trade unions, the CCMA, any bargaining council and any court.
- Fall-back limit. If a court finds that any part of this clause cannot be enforced, for example because the law does not allow liability for gross negligence to be excluded, the total liability of Compass HR and the persons named above, for all claims together, is limited to the fees you paid in the 12 months before the event that gave rise to the claim. This fall-back applies only to the extent that the full exclusion is unenforceable.
- This clause continues to apply after your account is closed.
9. The service
- We try to keep the App available, but we do not promise that it will always be available or free of errors. We may change, improve or stop features, and will give you reasonable notice of any change that materially affects what you have paid for.
- If we stop providing the App, we will give you at least 30 days' notice and refund any subscription fees paid for the period after it stops.
10. Ownership
Your case material, and the documents the App prepares for you, belong to you. The App, its design, its instructions and the case law bank belong to Compass HR.
11. Changes to these terms
We may change these terms. We will tell you by email and in the App, and you will be asked to accept the new terms before you continue using it. If you do not accept them, you may cancel your subscription.
12. Law and courts
South African law governs these terms. You consent, in terms of section 45 of the Magistrates' Courts Act 32 of 1944, to the jurisdiction of the Magistrate's Court for any matter arising from these terms, even if the amount claimed would otherwise be beyond that court's jurisdiction.
13. Notices
We choose 14 Chalbre Crescent, Bel Aire, Somerset West, 7130 as our address for legal notices. You agree that notices may be sent to you at the email address on your account.
14. General
These terms are the whole agreement between you and Compass HR about the App. If any part is found to be unenforceable, the rest remains in force. If we do not enforce a right immediately, we have not given it up. Nothing in these terms takes away a right that the law gives you and does not allow to be excluded.
